Palestinian Poet wins court case against Israeli State
A four-year saga came to an end today. Poet Dareen Tatour’s acquittal for the poem she wrote is now final.

The Israeli Supreme Court today rejected the state’s motion for appeal against the decision of the Nazareth District Court that acquitted poet Dareen Tatour for offences related to the poem she wrote.
It is inconceivable that the State Prosecution filed this request in the first place — as it seeks to reduce the freedom of artistic expression and creative freedom under false claims, as if the Nazareth court had come up with a new status granting poets privileges.
The request for an appeal is a badge of shame for the State Prosecution, which couldn’t accept the democratic principle under which the creator has the right to defend their work. In fact, the State Prosecution’s Office sought to repeal the Supreme Court’s extensive ruling protecting the freedom of artistic expression and creative freedom.
Now it is clear that the criminal stain that they were trying to affix to Dareen’s poem has finally been removed.

בית המשפט העליון דחה היום את בקשת המדינה לרשות הערעור על החלטת ביהמ”ש המחוזי בנצרת שזיכה את המשוררת דארין טאטור בעבירות הקשורות לשיר שכתבה.
זה בלתי נתפס שפרקליטות המדינה הגישה בקשה זו מלכתחילה — מאחר והיא מבקשת לצמצם את חופש הביטוי האמנותי וחופש היצירה בטענות כוזבות, כאילו שביהמ”ש בנצרת המציא מעמד חדש המעניק זכויות יתר למשוררים.
הבקשה לרשות ערעור היא תעודת עניות לפרקליטות המדינה אשר לא יכולה להשלים עם העקרון הדמוקרטי לפיו, ליוצר והיוצרת הזכות להגן על יצירתה. למעשה ביקשה הפרקליטות לבטל את הפסיקה העניפה של ביהמ”ש העליון המגינה על חופש הביטוי האמנותי וחופש היצירה.
